There being no objection, it was so ordered. Amendment No. 1 was offered by Representatives Brown, Porter and Mackie: Page 2, following line 5: Insert a new subsection to read: "(d) This section does not apply to viewing or photography conducted by a law enforcement agency for a law enforcement purpose." Reletter the following subsections accordingly. Representative Brown moved and asked unanimous consent that Amendment No. 1 be adopted. There being no objection, it was so ordered. 1995-03-17 House Journal Page 0782 HB 188 Amendment No. 2 was offered by Representatives Brown, Porter and Mackie: Page 2, line 15, following "being": Insert "(A) viewed by the defendant; or (B) produced in a picture; "private exposure" does not include the exposure of a person's body or body parts in a law enforcement facility, correctional facility, designated treatment facility, or a juvenile detention facility; in this paragraph, "correctional facility" has the meaning given in AS 33.30.901, "designated treatment facility" has the meaning given in AS 47.30.915, and "juvenile detention facility" has the meaning given in AS 47.10.990." Page 2, lines 16 - 17: Delete all material. Representative Brown moved and asked unanimous consent that Amendment No. 2 be adopted. There being no objection, it was so ordered. Amendment No. 3 was offered by Representative Finkelstein: Page 2, line 2: Delete "C felony" Insert "A misdemeanor" Representative Finkelstein moved and asked unanimous consent that Amendment No. 3 be adopted. Representative Mackie objected. Representative Finkelstein moved and asked unanimous consent that Amendment No. 3 be withdrawn. There being no objection, it was so ordered. Representative Vezey moved and asked unanimous consent that CSHB 188(JUD) am be considered engrossed, advanced to third reading and placed on final passage.
